New York Lead Poisoning Lawyer

Lead paint, mold & other landlord defense litigation

Rich Fogel has represented landlords, property managers and related companies in lead paint, mold and other toxic tort cases for two decades throughout the greater New York City area including Westchester, Nassau and Suffolk counties. Among the many notable cases handled by Mr. Fogel is the seminal case Andrade v. Wong, 251 A.D.2d 609, 675 N.Y.S.2d 112 (2d Dep’t 1998), in which the Appellate Division granted summary judgment to the landlord in Queens. The focus of the defense effort on behalf of our clients in these and all litigation is cost effective defense and resolution.

In multiple dwelling situations involving New York City Local Law 1, the firm has been able to resolve the suits based upon defenses of lack of causation of the claimed injuries as well as the residential and medical history of the plaintiffs. In mold cases, the firm has obtained summary judgment for landlords, (See Diamond v. AKA Holdings Ltd. P’ship, No. 8652/07 (Nassau C’nty S. Ct., July 21, 2010)) and resolved litigation on reasonable and cost-effective terms arguing lack of causation based upon scientific evidence, expert opinion and legal precedent.

Mr. Fogel’s background as a scientist with a Master’s Degree makes him uniquely qualified to present complex scientific testimony to the court and jury and work effectively with highly qualified experts. The firm is also well equipped to handle related coverage litigation because of its two decades of experience in complex toxic tort and environmental coverage disputes. Notably, Mr. Fogel successfully obtained summary judgment for a landlord sued by an insurance company over coverage for a lead paint claim in the Bronx and obtained reimbursement of all the landlord’s defense costs in the coverage litigation as well as the underlying lead paint law suit, (See American Home Ass. Co v. Ivory Holding Co., No. 24476/97 (Bronx C’nty S. Ct. Feb. 9, 2005)).

If you are sued in a lead paint, mold, dry wall, asbestos, benzene or other toxic tort case, as a landlord, property manager or other defendant, whether you have insurance coverage for the claim or not, contact the Law Offices of Richard A. Fogel, P.C. Our lead poisoning lawyer has unique experience and qualification to cost effectively defend you that is not found in most of our competitors. When you retain Rich Fogel, he personally handles every aspect of your case, not some second or third year associate. Moreover, our firm’s business model is designed to keep overhead to a minimum to serve our small business, and cost sensitive clients and as a result our rates are very favorable compared to the vast majority of law firms in the New York City area.
